These Terms of Use (“Terms”) are an agreement between you and BytExplorer (“BytExplorer”, “we”, “us”) governing your use of the BytExplorer website, learning platform and related services (the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
1. Eligibility & age
You must be at least 18 years old to create an account and use the Service on your own. If you are under 18 but old enough to use the Service under the law of your country, you may only use it with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. By using the Service you confirm that you meet these requirements.
You also confirm that the information you give us is accurate and that you are not barred from using the Service under the laws of the United States, Canada, Australia, New Zealand or your place of residence.
2. Your account
- You’re responsible for keeping your password and account secure, and for everything that happens under your account.
- One account per person; don’t share your login or impersonate anyone else.
- Tell us promptly at [email protected] if you suspect unauthorised use of your account.
3. Subscriptions, billing & renewals
Parts of the Service are free; others require a paid subscription. Paid plans are billed through Stripe. By subscribing you authorise us, via Stripe, to charge the plan price to your payment method.
- Plans & pricing — current prices are shown on our Pricing page. Prices are in US dollars unless stated otherwise. We may change prices for future billing periods, with notice.
- Auto-renewal — subscriptions renew automatically at the end of each term (monthly, six-monthly or annually) until you cancel. Each renewal charges the then-current price for your plan.
- Cancelling — you can cancel anytime yourself from your billing settings, with no need to contact us or complete extra steps. Cancellation stops future renewals; you keep access until the end of the period you’ve already paid for.
- Taxes — prices may not include applicable taxes (such as sales tax or GST), which may be added at checkout where required.
4. Refunds
We offer a 7-day money-back refund for new purchases. To request a refund, you must email [email protected] within 7 days of your purchase and include the email address used for your BytExplorer account.
If your refund request is approved, we will refund the amount paid for your current subscription period to the original payment method where possible. After the 7-day refund period, payments are generally non-refundable and we do not provide refunds or credits for partial subscription periods, except where required by applicable law.
Approved refunds are issued promptly, usually within a couple of business days. Depending on your bank or card issuer, it can then take a further 5–10 business days for the funds to appear on your statement.
Refunds are not intended to apply to repeated purchases, abuse, or attempts to access a substantial amount of course content and then request a refund. We may refuse refund requests where we reasonably believe the refund policy is being misused.
If something has gone wrong with a charge, please email us before disputing it with your bank or card issuer — we can usually resolve refund requests faster directly.
Nothing in these Terms limits any consumer rights that cannot be excluded under the laws that apply to you, including rights under the Australian Consumer Law, the New Zealand Consumer Guarantees Act, or other applicable consumer-protection laws.
5. Discounts & referral codes
We may offer discount or referral codes. They have no cash value, can’t be combined unless we say so, may be limited in time or quantity, and may be changed or withdrawn at any time. Misuse of codes (for example, fraud or self-referral abuse) may result in cancellation of the discount and/or your account.
6. Acceptable use
When using the Service, you agree not to:
- break the law, infringe others’ rights, or harass, abuse or harm anyone;
- copy, scrape, resell, sublicense or publicly redistribute our course content;
- share your paid access with people who haven’t paid;
- attempt to break, overload, probe or bypass the security of the Service or our code-execution environment, or run malicious, unlawful or resource-abusing code;
- upload malware, or attempt to gain unauthorised access to any account, system or data;
- use bots or automated means to access the Service except as we expressly allow.
7. Course content & intellectual property
The Service and its content — lessons, text, code samples, graphics, branding and software — are owned by BytExplorer or our licensors and are protected by intellectual-property laws. While your account is in good standing, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own learning. You may use code examples we provide in your own projects, but you may not redistribute our courses or present our materials as your own.
8. Your content
You keep ownership of the code and other content you submit. You grant us a limited licence to host, run, store and process it as needed to operate the Service (for example, to execute your code and save your progress). You’re responsible for what you submit and confirm you have the right to submit it.
9. Community & third-party services
Our community runs on Discord, and we use third-party providers such as Stripe, Google and GitHub. Your use of those services is also subject to their own terms and policies. In our Discord and any community space, be respectful and follow the posted rules; we may remove content or members who break them. We’re not responsible for third-party services we don’t control.
10. Disclaimers
BytExplorer is an educational service. We work hard to keep content accurate and useful, but we don’t guarantee any particular learning outcome, job, certification or result. Except where the law says otherwise, the Service is provided “as is” and “as available”, without warranties of any kind, and we don’t warrant that it will be uninterrupted, error-free or secure. Some jurisdictions (including Australia and New Zealand) give you guarantees that can’t be excluded — nothing here limits those.
11. Limitation of liability
To the maximum extent permitted by law, BytExplorer will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Where liability can’t be excluded but can be limited, our total liability to you is limited to the amount you paid us for the Service in the 12 months before the claim. This section does not limit any liability that cannot be limited under applicable law (including your non-excludable consumer rights).
12. Indemnity
To the extent permitted by law, you agree to cover us for reasonable losses and costs arising from your misuse of the Service or your breach of these Terms or of someone else’s rights.
13. Suspension & termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where we’re required to by law. If we terminate your account without cause while you have a paid subscription, we’ll refund the unused portion of your current term.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. Governing law & disputes
These Terms are governed by the laws of [the State/Province and country where BytExplorer operates], without regard to conflict-of-law rules, and you and we submit to the courts of [the same place — e.g. the courts of that State/Province] — except that this does not deprive you of the protection of mandatory consumer laws in your country of residence, and you may also have the right to bring proceedings in your local courts. We encourage you to contact us first at [email protected] so we can try to resolve any issue informally.
16. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term isn’t a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us about the Service. You can’t transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets.
